Unfortunate collateral rape stories damage, but no war crime. b) If the driver was ignoring normal driving protocols and passed the boundary where the gunner’s Rules of Engagement allowed him/her to open fire, no war crime. c) If the gunner opens fire on an innocent driver who the gunner THOUGHT was a suicide bomber, then no war crime. d) If the gunner opens fire knowing the driver is an innocent civilian, but perceives the vehicle to be encroaching on the RoE boundaries, but while planning to disable the vehicle accidentally kills the driver and the passenger, no war crime. e) If the gunner opens fire knowing the driver and passenger are innocent civilians and they are not encroaching on any boundaries set by the RoE, but the gunner is a sadistic bastard and just wants to see someone get shot, then yes, a possible war crime.
