You need a much more detailed parenting plan than what you have. do some research at the sites i mentioned earlier and try to work this out before the judge works it out for you. there have been many cases where custody has been reversed for non- cooperation with a court order. try to work with him. and yes under the circumstances if he is actually keeping the child 1/2 the month then he would be eligible for a deviation of support under most state rules. |

It doesn't have anything to do with visitation, but how far behind in support is he? If he has shared custody of the child, it is quite possible that he could get the support drasticaly reduced or stopped all together. If the child is having fits every time he goes to dad's house, there has to be some reason. Which means, either dad has done something awful and the child is scared of him or he is reacting to the wat YOU feel about it. If dad had been the reason, he wouldn't have been awarded with 50/50 custody. So, that leaves you. You can try to use the fact that dad has not been using his time with the child, but I'd bet he is going to say that the reason he doesn't use the time is because you have allowed the child to get so carried away with his tantrums that he is HAVING to bring the child back after only a day or 2. |
